Why Am I a Write-In Candidate For Harris County Judge?

Yes. Texas Law provides a process for qualified candidates to run as declared write-in candidates. As many of you know, Texas politics is demanding and a tough business — not for the faint of heart, and not for anyone unwilling to stand for responsible government, safe communities, and accountable leadership. As an Independent Candidate it can be difficult to navigate your way through the election process dominated by the two-party political establishment.

Declaration of Intent to Run as an Independent Candidate

In order to have my name on the ballot for Harris County Judge, I needed to file a Declaration of Intent to Run as an Independent Candidate for the General Election for State and County Officers with the Texas Secretary of State's Office in Austin or the Harris County Commissioners Office. On December 8, 2025, I turned in my Declaration of Intent with the Texas Secretary of State in Austin. The document was reviewed by the attorneys and staff representing the S.O.S. Office, time stamped, signed, notarized, and accepted by the election officers. Later that evening I received an email saying that the Secretary of State made a mistake in accepting my application and that it should have been filed in Houston. On December 10, 2025, I presented my concerns to a very high-ranking County Representative and we spoke about the incident. She thought the wording on the website was an improper sentence structure and that she had advised the local administration to correct the website information. The high-ranking official said, "Mr. Duncan, you followed the website instructions and they led you wrong."

A Matter for the 133rd District Court to Decide

The Harris County Official advised me that to correct this matter and to have my name added to the ballot for November 2026, I needed to file a Mandamus Lawsuit seeking a remedy through the Courts. A lawsuit was filed in the 133rd District Court of Texas — Vincent Duncan v. Texas Secretary of State, Cause No. 202594747. I had my day in court presenting my case and the evidence to support my petition. After a few weeks of waiting for the Court's decision, the 133rd Court ruled against me and in favor of the State and County. However, the Courts left open the opportunity to appeal the Court's ruling.

I Chose to Continue

Running as a write-in candidate is more difficult because the voters must know my name and intentionally cast their vote for me rather than selecting a printed name on the ballot. But difficult does not mean impossible, and it does not mean illegitimate. This campaign is about more than how my name appears on the ballot. It is about giving Harris County residents another choice and continuing a campaign centered on Responsible Government, Safe Communities, and Accountable Leadership. This is why I am continuing as a candidate for Harris County Judge.
